These Terms of Use govern access to and use of the Nesmofy platform, including the creator dashboard, checkout pages and all related features.
By using the platform, you agree to follow these rules and all applicable laws.
2. Acceptance of the terms
By creating an account or using any Nesmofy feature, you confirm that you have read, understood and accepted these Terms. If you do not agree with any provision, do not use the platform.
3. Use of the platform
Nesmofy provides tools to create, promote, sell and deliver digital products, monitor performance and receive payments.
You may not use the platform for illegal, fraudulent or misleading activities, or in any way that infringes the rights of others.
4. User account
Access is limited to approved users. You are responsible for keeping your credentials confidential and for all activity carried out through your account.
Registration information must be accurate, complete and kept up to date.
5. Sales and transactions
Prices are displayed at checkout before confirmation. Payments are processed through the methods available on the platform, such as M-Pesa, e-Mola and cards.
A purchase is confirmed only after the relevant payment provider approves it. Nesmofy may charge fees on approved sales, which are communicated to the creator in advance.
6. User responsibilities
Each creator is responsible for the content, legality, delivery and support of the products they sell, as well as compliance with applicable tax obligations.
7. Intellectual property
The Nesmofy brand, software, interface and other platform elements are protected by intellectual property rights and may not be copied, modified or distributed without written permission.
8. User content
You retain ownership of the content you upload and grant Nesmofy a limited licence to store, process and display it solely to provide the service.
9. Limitation of liability
Nesmofy acts as a sales platform and is not liable for indirect losses arising from the relationship between a creator and a buyer, or for outages caused by third parties.
10. Account suspension or closure
Accounts may be suspended or closed for violating these Terms, suspected fraud or legal requirements. Users may request account closure at any time.
11. Changes to these terms
These Terms may be updated. Material changes will be communicated through the platform and take effect on the published date.
12. Applicable law
These Terms are interpreted under the laws applicable to the service and the user, without limiting any mandatory rights provided by law.
